Terms and Conditions
This Agreement for design services is between Fortune Publishing Group, LLC. (“Designer”), and (Client), for the performance of the services described herein. The parties, therefore, agree as follows:
Project Title/Description: Client Website will be a 5-10 page Responsive Online University web design to include (Home, About, Contact, Forms, Services), Works on all modern browsers (IE9+, Latest Build of Firefox, Chrome and Safari).
Schedule: Preliminary Designs: 4 weeks after deposit received, Final Design: 8-10 weeks after payment received.
Fee: $10,000.00 USD upfront or 3 installment payments of $3,595.00 on auto pay and due monthly
Payment Schedule: Full hours to be completed by the conclusion of the project or no later than after deposit is received.
Scope of Work: We will develop a multi-page responsive website for the Client, the goal of this website is to provide an online presence and to provide current and prospective customers vital information about The business operations.
The website will have the following functionality:

Revisions: Revisions may be made only by Fortune Publishing Group, LLC at the Preliminary Design phase. Additional fees will be charged for revisions made after 3 preliminary design revisions, and for additions to project scope.
Cancellation Fees: In the event of Cancellation, Fortune Publishing Group, LLC will be compensated for services performed through the date of cancelation in the amount of a prorated portion of the fees due. Upon cancellation, all rights to the website revert to the Fortune Publishing Group, LLC and all original art must be returned, including sketches, comps, or other preliminary materials.
Refunds: There will not be a refund of Deposits or any monies paid once Fortune Publishing Group, LLC. accepts payment and begins work.
Credits and Promotion: A credit line suitable to the design of the pages will be used. Client agrees to pay an additional fifty percent (50%) of the total fee, excluding expenses, for failure to include a credit line. Excel Media Group, LLC ( a division of Fortune Publishing Group) reserves the right to include screenshots of the completed work in his portfolio.
CHANGES
General Changes. Unless otherwise provided in the Proposal, and except as otherwise provided for herein, Client shall pay additional charges for changes requested by Client which are outside the scope of the Services on a time and materials basis, at Designer’s standard hourly rate of Designer’s Hourly Rate per hour. Such charges shall be in addition to all other amounts payable under the Proposal, despite any maximum budget, contract price or final price identified therein. The designer may extend or modify any delivery schedule or deadlines in the Proposal and Deliverables as may be required by such Changes.
Substantive Changes. If Client requests or instructs Changes that amount to a revision of at least 15% of the time required to produce the Deliverables, and or the value or scope of the Services, Designer shall be entitled to submit a new and separate Proposal to Client for written approval. Work shall not begin on the revised services until a fully signed revised Proposal and, if required, any additional retainer fees.
